The rules that apply when you use this website.
1. Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of www.epicmod.ca (the “Site”), operated by EpicMod Building Systems Inc. (“EpicMod”, “we”, “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Product information and pricing
- All content on the Site is provided for general information. Floor plans, dimensions, square footage, renderings, photographs, specifications, inclusions, and delivery timelines are representative and may change without notice as products are refined and as building-code requirements evolve.
- Prices shown are in Canadian dollars, exclude GST/HST, and, unless stated otherwise, exclude transportation to site, foundations, site work, utility connections, permits, and optional upgrades. Prices are subject to change without notice.
- Information on the Site is not an offer capable of acceptance. Any purchase is governed solely by a written purchase agreement signed by you and EpicMod, which will set out the final price, specifications, inclusions, payment schedule, delivery terms, and warranty. If there is any inconsistency between the Site and a signed agreement, the agreement prevails.
- Delivery estimates (for example, “10–12 weeks post-order”) are targets based on typical projects and depend on permit approval, site readiness, weather, and factory scheduling.
3. No professional advice
Nothing on the Site is legal, financial, engineering, planning, or building-code advice. Whether a modular home or accessory dwelling unit can be placed on a particular property depends on municipal zoning, by-laws, setbacks, servicing, and permit requirements that vary by location and change over time. You are responsible for confirming these requirements with your municipality and qualified professionals before relying on any information here. Engineering drawings supplied by EpicMod are prepared to the Ontario Building Code, but permit issuance is at the discretion of the authority having jurisdiction.
4. Intellectual property
The Site and its content, including text, floor plans, designs, renderings, photographs, videos, logos, and the EpicMod name and model names, are owned by or licensed to EpicMod and are protected by Canadian and international copyright and trademark laws. You may view, download, and print pages for your own personal, non-commercial use in evaluating our products. You may not otherwise reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.
5. Acceptable use
You agree not to: (a) use the Site in any way that breaks the law or infringes anyone’s rights; (b) attempt to gain unauthorized access to any part of the Site, our systems, or our administration tools; (c) use automated tools to scrape, crawl, or harvest content or personal information from the Site beyond what search engines do for indexing; (d) introduce viruses or other harmful code; or (e) interfere with the operation or security of the Site.
6. Forms and submissions
When you submit an inquiry or application through the Site you confirm that the information is accurate and that you are authorized to provide it. Submitting a form does not create a contract, reserve a unit, or guarantee a response within a particular time, although we aim to reply within one business day. We may decline any inquiry or application at our discretion. Personal information you submit is handled as described in our Privacy Policy.
7. Third-party services and links
The Site uses third-party services to deliver forms and to host and protect the Site, and it links to websites we do not control. We are not responsible for the content, accuracy, availability, or privacy practices of any third-party site or service, and a link does not imply endorsement.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Product warranties (for example, the structural warranty on a home you purchase) are set out in your purchase agreement and are not affected by this section.
Nothing in these Terms limits any rights you have under the Ontario Consumer Protection Act, 2002 or other consumer-protection legislation that cannot be excluded by contract.
9. Limitation of liability
To the fullest extent permitted by law, EpicMod, its directors, officers, employees, agents, and dealers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of or inability to use the Site or your reliance on its content, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Site is limited to CAD $100. This section does not apply to liability that cannot be limited by law, including liability arising under a signed purchase agreement, which is governed by that agreement.
10. Indemnity
You agree to indemnify and hold EpicMod harmless from any claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. You agree that the courts of Ontario have exclusive jurisdiction over any dispute relating to the Site or these Terms, except that consumers may also rely on the mandatory consumer-protection rules and forums of the place where they live.
12. General
We may update these Terms at any time by posting a revised version with a new effective date; continued use of the Site after a change means you accept it. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy, are the entire agreement between you and EpicMod regarding use of the Site.
